1. Acceptance of Terms

By downloading, installing, or using Growly ("the App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the App.

2. Definitions

• "App" refers to the Growly iOS application.
• "User" or "you" refers to any person who downloads or uses the App.
• "We", "us", or "our" refers to Vitalii Honchar, the developer of Growly.
• "Premium Subscription" refers to the optional yearly paid plan that unlocks additional features.

3. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you must have parental or guardian consent. The App requires iOS 17.0 or later.

4. Account & Data

No account creation is required to use Growly. All your data is stored locally on your device and, if enabled, synced via your personal iCloud account (Apple ID). You are responsible for maintaining the security of your device and iCloud account.

5. Premium Subscription

• Growly offers an optional yearly Premium subscription managed through the Apple App Store.
• Payment is charged to your Apple ID at confirmation of purchase.
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.
• You can manage or cancel your subscription in your iPhone's Settings > Apple ID > Subscriptions.
• Refunds are handled by Apple in accordance with their refund policies.

6. Permitted Use

Growly is provided for personal, non-commercial use. You may use the App to track your own budget, habits, goals, and nutrition.

7. Prohibited Conduct

You agree not to:

• Reverse engineer, decompile, or disassemble the App.
• Copy, redistribute, or sublicense the App or any portion of it.
• Use the App for any unlawful purpose.
• Attempt to circumvent any security features of the App.

8. Receipt Scanning

The App may request access to your camera and photo library solely for the purpose of scanning receipts using on-device optical character recognition (OCR). Receipt images are processed entirely on your device using Apple's Vision framework and are never transmitted to external servers.

9. Third-Party Services

The App uses Firebase Analytics and Firebase Crashlytics (by Google) for anonymous usage metrics and crash reporting. These services are subject to Google's privacy policies. The App may also use Apple's iCloud and CloudKit services for data synchronization, subject to Apple's terms of service.

10. Intellectual Property

Growly, including its design, code, content, and branding, is the intellectual property of Vitalii Honchar. All rights are reserved. The App is licensed to you, not sold.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. Growly is not a financial advisor, health advisor, or nutritionist. The App is a tracking tool and does not provide professional financial, health, or dietary advice. Always consult qualified professionals for financial and health decisions.

12. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

13. Termination

You may stop using the App at any time by uninstalling it from your device. We reserve the right to discontinue the App or any features at any time without prior notice.

14. Changes to Terms

We may update these Terms from time to time. Changes will be communicated through App Store release notes. Your continued use of the App after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.
